Professional Indemnity Protection
Protection for eligible allied health and related members
Protection is granted at the discretion of the Mutual’s Board and is not a contract of insurance. Legal defence costs are included within the limits. You pay no excess. Cover applies to services provided on or after 15 October 2015.
What eligible AMPS members have access to
- $10 million for each claim, under each section (Professional Indemnity, Medical Malpractice, Products Liability and Public Liability).
- $20 million combined aggregate, across all sections and all members, in any one protection period.
- Legal defence costs are included within those limits.
- Nil excess. You are never liable for the first $1,000,000 of a claim, which the Mutual funds itself.
- Cover applies to services you provided on or after 15 October 2015 (the retroactive date).
- 84 months (seven years) of cover after you register with AMPS as having ceased practice.
- Australia and New Zealand, and business visits elsewhere (excluding the USA and Canada). This often applies to volunteer postings overseas, so contact us first if you are considering one.
Registered health practitioners need appropriate professional indemnity arrangements in place under s 129 of the Health Practitioner Regulation National Law, as it applies in each state and territory, regulated by Ahpra and the National Boards.
Professional Indemnity is included as a benefit of membership for eligible employees. We do not sell insurance. If you work as a contractor, our hotline can refer you to our insurance broker for your own cover.

Professional Indemnity FAQs
- Professional Indemnity and Public Liability protection is provided at the discretion of the Board of Red Union Workers’ Mutual Limited. It is not a contract of insurance, and you do not hold an insurance policy.
- Protection is granted subject to the Constitution, Rules and Protection Wording of the Mutual. The Board decides whether to grant protection and how much to pay, in good faith. You have an automatic right to have a claim considered by the Board, not an automatic right to be paid.
Read the full disclosure in the Red Union User Agreement.
You must be:
- a financial member or a financial affiliate member, and maintain that status while you are working;
- a non-working member or affiliate who is registered with AMPS in that capacity;
- a student registered with AMPS (covered for the entire period of your studies, including clinical placements); or
- an Honorary Life Member of AMPS.
You must also work as an employee in one of the roles listed in the next question.
- Allied health: physiotherapists, occupational therapists, podiatrists and psychologists.
- Registered nurses, enrolled nurses and midwives.
- Paramedics, ambulance officers and pharmacists.
- Ancillary and related services: care workers, assistants in nursing, dental nurses, orderlies and administrators.
- Alternative and natural therapies: acupuncture, aromatherapy, naturopathy, massage and reflexology.
- Training, education and voluntary work in these services.
- Doctors. Medical practitioners are not in the eligible class, even though they belong to AMPS. We are in active negotiations to add professional indemnity protection to the AHPRA support and case management we already provide AMPS doctors.
- Anyone who is not an employee. If you work as an independent contractor you are not covered for that work. If you are an employee for part of your week, you are covered only for the employed part.
- Anyone working in the USA or Canada.
- Radiographers and sonographers.
- Employees of some small private clinics may not be covered, so check with us first.
- Civil liability for loss arising from an actual or alleged negligent act, error or omission when you provide your professional service.
- Representation if you are summoned to give evidence before a coronial inquest.
- Unintentional defamation arising from your professional service, including allegations of inappropriate cultural safety practice.
- Good Samaritan acts, where you voluntarily provide life-saving or life-extending services at the scene of a medical emergency or while doing voluntary community service.
- Legal representation at an AHPRA or National Board hearing, where the Mutual has agreed in writing first.
- Public Liability, to $10 million, for claims from members of the public arising from your work.
- Criminal offences, and the defence of criminal charges. Also claims arising from deliberate, reckless, dishonest, fraudulent or malicious acts.
- Any allegation of abuse, harassment or conduct of a sexual or physically violent nature, including the cost of responding to it, whether or not it is proven.
- Telehealth and virtual consultations.
- Cyber loss and data breaches.
- Workplace, unfair dismissal, discrimination and enterprise bargaining matters. AMPS support covers these, not the Mutual.
- Claims where you are entitled to cover from your employer or another valid arrangement. Protection responds only above it.
- Nutraceutical and aesthetic products and services, as listed in the Protection Wording.
- Claims from anyone who is not financial, unless you registered with AMPS as having ceased practice. In that case cover continues for another 84 months (seven years). Non-working members who remain registered are still covered.
- Claims not notified to us in the protection period in which you became aware of the circumstances.
No. No member or affiliate pays any excess on a claim. The Mutual funds the first $1,000,000 of every claim from its own assets.
The Mutual holds excess of loss reinsurance with Tokio Marine Kiln Syndicates Limited (Lloyd’s Syndicate 0510 KLN), placed through Price Forbes & Partners. It sits above the first $1,000,000 of each claim. The reinsurance is an arrangement between the Mutual and its reinsurer, so you have no right to claim on it and must never notify a claim to a reinsurer.
Tell us as soon as you become aware of a claim or a circumstance that could lead to one. Call (07) 3497 5048 or email hotline@amps.asn.au. After your protection period ends you have an automatic 60 days to notify a claim that first arose during it. If you are notified of an AHPRA or National Board matter, tell us straight away. Do not admit liability or settle anything without the Mutual’s written consent.
